{"id":76171,"date":"2024-06-01T00:00:16","date_gmt":"2024-06-01T04:00:16","guid":{"rendered":"https:\/\/todaysveterinarybusiness.com\/?p=76171"},"modified":"2024-05-22T16:19:43","modified_gmt":"2024-05-22T20:19:43","slug":"noncompete-agreements-0601","status":"publish","type":"post","link":"https:\/\/navc.sitepreview.app\/todaysveterinarybusiness.com\/noncompete-agreements-0601\/","title":{"rendered":"More to Come &#8230;"},"content":{"rendered":"<p>The Federal Trade Commission made headlines in April by banning most noncompete agreements. Such restrictive covenants, for example, might bar an associate veterinarian who signs one from going to work at a practice across town.<\/p>\n<p>The 3-2 vote outraged the business world. The U.S. Chamber of Commerce quickly filed suit in an attempt to kill what\u2019s formally called the Noncompete Clause Rule.<\/p>\n<p>Labor attorney Brent R. Pohlman, a colleague of <a href=\"https:\/\/todaysveterinarybusiness.com\/column\/legal-lingo\/\">Legal Lingo columnist Peter H. Tanella<\/a>\u2019s, predicts a lengthy court fight and postponement of the rule\u2019s implementation. \u201cI expect it to go to the Supreme Court,\u201d he said.<\/p>\n<p>Here\u2019s what he is telling veterinary professionals and practice owners:<\/p>\n<ul>\n<li><strong>On the rule\u2019s validity:<\/strong> \u201cThe ultimate issue is whether the FTC usurped the authority of Congress by enacting the rule. There\u2019s a difference between administrative rulemaking and promulgating legislation.\u201d<\/li>\n<li><strong>On current noncompete agreements:<\/strong> \u201cThe rule doesn\u2019t insulate employees from breaches prior to the rule\u2019s effective date. An employee would still be subject to any penalties, restrictions and injunctive relief that the contract provides. You can ask whether an employer will pursue litigation, but the rule says any breach prior to the effective date can still be enforced.\u201d<\/li>\n<li><strong>On allowing current agreements with senior executives to continue:<\/strong> \u201cThe rule identifies two specific positions: CEO and president, or a position with a similar role or authority. After that, the exemption applies to individuals with policymaking authority, and it has to be more than advice or influence. It has to be an individual with the ability to implement policies that relate to significant aspects of a veterinary practice\u2019s operations. And they have to make more than $151,000 a year in base <a href=\"https:\/\/todaysveterinarypractice.com\/diversity-equity-inclusion\/assessing-the-gender-pay-gap-in-veterinary-medicine\/\">compensation and bonuses<\/a>.\u201d<\/li>\n<li><strong>On noncompete agreements for senior executives after the effective date:<\/strong> \u201cThe exemption is only for existing agreements. It\u2019s not as though there will be a senior executive exemption in perpetuity.
