{"id":75983,"date":"2024-04-01T00:00:53","date_gmt":"2024-04-01T04:00:53","guid":{"rendered":"https:\/\/todaysveterinarybusiness.com\/?p=75983"},"modified":"2024-03-27T18:39:37","modified_gmt":"2024-03-27T22:39:37","slug":"dea-lets-talk-drugs-0424","status":"publish","type":"post","link":"https:\/\/navc.sitepreview.app\/todaysveterinarybusiness.com\/dea-lets-talk-drugs-0424\/","title":{"rendered":"No More Excuses"},"content":{"rendered":"<p>At 6:15 a.m. on a Thursday in February, a practice owner texted me this: \u201cUrgent! Please call! Emergency situation!\u201d The veterinarian, who was also the hospital\u2019s <a href=\"https:\/\/todaysveterinarybusiness.com\/veterinary-acquisition-controlled-substance-guidelines\/\">Drug Enforcement Administration registrant<\/a>, later told me that three DEA diversion investigators conducted an unannounced inspection the previous day after an unusually large order of controlled substances was placed under her registration. A distributor flagged the order as suspicious.<\/p>\n<p>When the DEA asked about it, the registrant responded: \u201cI had no clue. I haven\u2019t placed orders in years. My staff handles ordering.\u201d<\/p>\n<p><em>Note: Wrong answer! Strike one.<\/em><\/p>\n<p>When the DEA asked whether a power of attorney was in place for the individual ordering Schedule II controlled substances, her response was, \u201cI didn\u2019t know I needed one.\u201d<\/p>\n<p><em>Note: Wrong answer! Strike two.<\/em><\/p>\n<p>When the DEA asked why the registrant didn\u2019t handle controlled substance orders herself, she said she didn\u2019t know of any veterinarians who had time for ordering. She also admitted that she had never logged into the online ordering platform.<\/p>\n<p><em>Note: Volunteering information on top of a bad answer can worsen a situation.<\/em><\/p>\n<p>When the DEA asked whether she had required background checks or drug testing for individuals authorized to order or work with controlled substances, the registrant said \u201cno\u201d because she \u201cliked to give opportunities to individuals who had a hard time finding a job and frequently hired individuals living in halfway houses.\u201d<\/p>\n<p><em>Note: A terrible answer!<\/em><\/p>\n<p>After reconciling the controlled substance logs against the physical inventory, one of the DEA investigators asked whether the registrant was aware that over 40 tablets were missing from a bottle. The registrant said she was not. The investigators also found multiple containers of controlled substances never used to treat patients, along with three bottles that had been dispensed and commingled with the inventory. When questioned, the registrant said she had no idea where any of it came from.<\/p>\n<p><em>Note: Wrong answer! Strike three.<\/em><\/p>\n<p>The registrant commented that she would have questioned things had she not been so busy trying to keep her practice afloat.<\/p>\n<p><em>Note: A response like that hands the DEA more rope with which to hang you.<\/em><\/p>\n<p>The registrant said not knowing how to manage controlled substances wasn\u2019t her fault because she didn\u2019t learn about DEA requirements in veterinary school. She added that drug diversion occurred twice when she was a student but that her school\u2019s instructors told her not to say anything because the issue would be handled internally.<\/p>\n<p><em>Note: The rope now has a noose. Game over.<\/em><\/p>\n<p>Let\u2019s dissect her responses one by one.<\/p>\n<h3><strong>\u201cI didn\u2019t know. No one told me.\u201d<\/strong><\/h3>\n<p>DEA registration is a privilege, not a right. The federal agency grants qualified individuals a DEA registration and can take it away. \u201cI didn\u2019t know\u201d and \u201cNo one told me\u201d aren\u2019t acceptable answers. The DEA <em>Practitioner\u2019s Manual<\/em> outlines the responsibilities and requirements that come with the privilege of having a practitioner\u2019s registration.<\/p>\n<p>The assistant administrator of the Diversion Control Division clearly states on Page 7 of the <em>Practitioner\u2019s Manual<\/em>, \u201cYour role in the proper prescribing, administering and dispensing of controlled substances is critical to the health of patients and helps protect society against drug abuse and diversion.\u201d<\/p>\n<p>Not reading the manual, just like not knowing your state\u2019s veterinary practice act, isn\u2019t a defensible argument.<\/p>\n<h3><strong>\u201cI\u2019m too busy.\u201d<\/strong><\/h3>\n<p>The DEA doesn\u2019t care how busy you are. According to the Code of Federal Regulations, one of your primary responsibilities as a registrant is to \u201cprovide effective controls and procedures to guard against theft and diversion of controlled substances.\u201d<\/p>\n<p>The comedian Kevin Hart is quoted as saying, \u201cI don\u2019t care how busy I am; I will always make time for what\u2019s important to me.\u201d Not making time to read and understand the <em>Practitioner\u2019s Manual<\/em>, the Controlled Substances Act and Title 21 of the Code of Federal Regulations tells the DEA that drug compliance isn\u2019t important to you.<\/p>\n<h3><strong>\u201cWe\u2019ve always done it this way.\u201d<\/strong><\/h3>\n<p>That excuse comes up a lot. And it comes up for good reason because the veterinary industry did things a certain way for a long time and flew under the DEA radar. All that changed when the opioid crisis spilled over from human health care to veterinary medicine.<\/p>\n<p>Times have changed, and DEA registrants are responsible for keeping up with changes. You must be diligent about learning new laws, staying current on federal regulations, and knowing your state\u2019s veterinary practice and pharmacy acts.<\/p>\n<p>Stop focusing on the rearview mirror. Look through the windshield.<\/p>\n<h3><strong>\u201cIt\u2019s never going to happen to me.\u201d<\/strong><\/h3>\n<p>Thinking the DEA won\u2019t show up at your veterinary practice is a choice to operate in ignorance. \u201cIt won\u2019t happen to me.\u201d Wrong! The minute you think like that, an inspection likely will happen. Ignorance is not bliss to the DEA.<\/p>\n<h3><strong>\u201cThey didn\u2019t teach this in veterinary school.\u201d<\/strong><\/h3>\n<p>Unfortunately, veterinary medicine schools don\u2019t always provide sufficient guidance on DEA responsibilities. Pharmacology is taught as part of the core curriculum, but the focus is more on the drugs routinely used in clinical situations. There\u2019s also a discussion about writing prescriptions into the medical record and giving one to a client. Many schools have law classes on legal issues facing the profession. However, much of what you learned is buried deep inside your brain by the time you\u2019re working in the clinical world.<\/p>\n<p>You enter a regulatory minefield when you apply for a Drug Enforcement Administration registration. It\u2019s time to sign up for the continuing education you need to be compliant with regulations and prevent diversion.<\/p>\n<h3><strong>\u201cIt\u2019s not my fault. I wasn\u2019t there.\u201d<\/strong><\/h3>\n<p>As a DEA registrant, you must be a physical presence and ensure proper oversight of your controlled substance inventory. The onus is on you. Telling the DEA, \u201cIt\u2019s not my fault,\u201d is an admission that you don\u2019t understand your role and responsibilities.<\/p>\n<h3><strong>\u201cHow could I have known?\u201d<\/strong><\/h3>\n<p>The Drug Enforcement Administration will always tell you it\u2019s your responsibility to know. When you accept the privilege of becoming a DEA registrant, your job is to know. You\u2019re legally obligated to implement adequate controls and oversight over the management of your inventory of controlled substances.<\/p>\n<p>You should have known.<\/p>\n<h3><strong>The Aftermath<\/strong><\/h3>\n<p>Here\u2019s what became of the case involving the early morning text message:<\/p>\n<ul>\n<li>The DEA didn\u2019t care that the veterinarian registrant didn\u2019t place the suspicious order.<\/li>\n<li>The DEA didn\u2019t accept her response that she didn\u2019t know how to access her controlled substance ordering platform and that she couldn\u2019t explain the inventory discrepancies.<\/li>\n<li>The DEA didn\u2019t care that she hadn\u2019t learned all the rules when she was in veterinary school.<\/li>\n<\/ul>\n<p>The diversion investigators departed with her DEA registration, her entire controlled substance inventory and her logbooks. The DEA also called the state boards to demand revocation of her ability to practice veterinary medicine. She is awaiting formal legal proceedings.<\/p>\n<p>Don\u2019t make the same mistakes that this registrant did. The errors are avoidable. Don\u2019t strike out.
